Terms and Conditions

  1. Acceptance of Terms By making a reservation, using any kayak or equipment provided by Bayou Adventure (“Company”), or opting into the SMS service, you (“Renter”) agree to these Terms and Conditions. If you do not agree to these terms, do not proceed with the reservation, use the equipment, or opt into the SMS service.
  2. Equipment Use and Safety Renter acknowledges that they are renting the equipment at their own risk and that kayaking involves inherent risks including, but not limited to, the risk of injury or death. Renter agrees to use the kayak and any other equipment provided by the Company in a responsible manner and in accordance with any safety guidelines provided by the Company, as well as all applicable laws and regulations. Renter confirms they are competent and comfortable with kayaking activities and familiar with boating safety. Renters must always paddle close to shorelines and out of boating channels, following safe kayaking practices as outlined by the Company.
  1. Disclaimer Renting kayaks from our self-serve locations is no different than renting a bike, car, or a kayak from a rental store. You are responsible for your own safety and decisions. The Company provides the equipment in a convenient manner and is not responsible for transporting it. If you do not feel safe paddling in a kayak or on a river, do not rent our equipment. Our self-serve kayaks are for paddlers who are comfortable being on the water. Kayaking on rivers is subject to organized boating traffic. Kayakers should always paddle close to the shorelines and stay out of the boating channels, unless crossing the river. Help keep everyone safe by reminding fellow kayakers to always paddle close to the shoreline and out of channels.
  2. Liability Waiver By agreeing to these terms, the Renter waives all liability, and the Company is not responsible for any injuries or damages related to kayak rental. The Renter assumes full responsibility for any loss, damage, or injury to themselves, others, or property arising from the use of the rented equipment.
  3. Age and Capacity Renters must be at least 18 years old and have the capacity to enter into a legally binding agreement. Minors must be accompanied by a legal guardian who agrees to these terms on their behalf.
  4. Equipment Condition and Return Renter agrees to inspect the equipment before use and notify the Company immediately of any defects. Renter agrees to return the equipment in the same condition as when rented, barring normal wear and tear. Renter will be responsible for any damage or loss of the equipment.
  5. Cancellations and Refunds The Company’s cancellation and refund policy will be as follows: All rentals are nonrefundable once the reservation time starts. You must cancel 1+ hour before in order to receive a 90% refund. If there is a chance of inclement weather soon, please wait until the weather is over to begin your rental. Please click the link in your confirmation email to cancel your rental and receive a refund. 

SMS Terms & Conditions

  1. Program Description: When opted-in, you will receive text messages (SMS/MMS) including confirmation, rental reminders, rental communication, and follow-up.
  2. Program Frequency: Message frequency varies depending on the conversation.
  3. Opt-Out: Text “STOP” to opt-out. A confirmation SMS will be sent. To rejoin, sign up as before or text “START”.
  4. Help: For issues, reply with HELP or email info@bayouadventure.com
  5. Interruption: Carriers are not liable for delayed or undelivered messages.
  6. Costs: Message and data rates may apply. Contact your wireless provider for plan details.
  7. Privacy: Refer to our privacy policy for privacy concerns.

 

Changes to Terms and Conditions The Company reserves the right to change these terms and conditions at any time. Any changes will be effective immediately upon posting to the Company’s website or direct communication to the Renter.

Governing Law These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company operates.

Acknowledgment By making a reservation, the Renter acknowledges they have read, understood, and agreed to be bound by these Terms and Conditions.
